Preface:-
Redevelopment of old and dilapidated buildings in the state is carried out by developers appointed by the concerned co-operative housing societies in conformity with the procedure under the provisions of the Development Control Regulations applicable to the concerned Planning Authority/Municipal Corporation/Local Self-Government Body. In such cases, the benefits accruing from projects are received by the developers. In such Redevelopment Process, the Project is implemented as per the whims of developer. Consequently, the participation of the stake holders in the project being minimal, they have to face various difficulties, if the project is stranded incomplete. In view thereof, if members of the concerned co-operative housing societies come together for self-redevelopment, the concerned co-operative housing society will retain its control over the Redevelopment Project and all benefits accruing from Redevelopment Project will be received by the members of co-operative societies. For this purpose, incentives have been granted under Government Resolution at Serial No.2, for accelerating self-redevelopment of the registered co-operative housing societies.
In a Co-operative Conference of Co-operative Housing Societies, the Hon’ble Deputy Chief Minister and the then Minister for Housing made some important announcements with a view to introducing speed and transparency in the self-redevelopment of co-operative housing societies. In view thereof, the Government contemplated the matter of revising the incentives granted under Government Resolution at Reference No.2 above.
GOVERNMENT RESOLUTION:-
By revising the provisions of Recommendation No.3 contained in Government Resolution at Serial No.2 above, under the Heading (Time Limit for Sanctioning Scheme), following Revised Directions are hereby given.
Time Limit for Sanctioning Scheme:- Under Single Window System, it would be mandatory to complete all permissions in the Self-Redevelopment Scheme of the co-operative housing societies, within 3 months of the date of receipt of proposal. In furtherance of Self-Redevelopment, all concerned Planning Authorities should initiate action in conformity with the said provisions and expeditiously dispose of proposals under Single Window System within the prescribed period.
02. By revising the provisions of Recommendation No.10 under the Heading (Nodal Agency) contained in Government Resolution at Serial No.2 above, the following Revised Instructions are hereby given:-
Nodal Agency:- A Nodal Agency is required to supply finance to the Registered Co-operative Housing Societies in the State opting for Self-Redevelopment, as well as to guide and encourage them from time to time, for the implementation of this Scheme. In view thereof, the State Co-operative Bank, which is the Apex Bank in the Co-operative Sector is hereby declared as the Nodal Agency for the Self-Redevelopment of Co-operative Housing Societies in the State and this Nodal Agency shall act through the means of the District Central Co-operative Bank in the respective district; Furthermore, for the areas covered by the Mumbai and Mumbai Suburban District, as well as the Mumbai Metropolitan Region (M.M.R.D.A Area), the Mumbai District Central Co-operative Bank (Mumbai Bank) is hereby declared as the Nodal Agency. In order to accelerate Self-Redevelopment of the co-operative housing societies, the said Nodal Agency should publish the entire procedure pertaining to Self-Redevelopment, its process and other elaborate details through various means of publicity. Besides, if other banks take initiative for accelerating Self-Redevelopment of co-operative housing societies, they too shall be declared as the Nodal Agency by this Department by taking a separate action in that regard.
