Preface:-
A Government Resolution for allotting ownership houses to the Government employees residing in Saoli Building situated within the locality of B.D.D. Chawls at Worli, but not forming part of B.D.D Chawls and owned by the Public Works Department, in lieu of their Service Quarters, was issued, vide Reference No. 3, hereinabove.
“B.D.D Chawls Redevelopment Project” has been included in the Hon’ble Chief Minister’s War Room. On 21.04.2025, a Meeting presided over by the Hon’ble Chief Minister was convened to conduct a Review of this Project. In this Meeting, directions were received from the Hon’ble Chief Minister that appropriate steps should be taken for revoking Government Resolution Dt. 28.01.2022, which pertained to the grant of ownership houses to the Government employees residing in Saoli building owned by the Public Works Department, situated within the B.D.D Chawls located at Worli, but not forming part of B.D.D Chawls, in lieu of their Service Quarters, and to plead for the Government in the related court cases pending before the Hon’ble High Court, Mumbai in consultation with the Hon’ble Advocate General, Maharashtra State.
Being aggrieved by the Government Resolution Dt. 28.01.2022 allotting an ownership house to the Government employees residing in Saoli building at Worli, in lieu of their Service Quarters, Writ Petition No. 37183/2022 and Writ Petition No. 4874/2024, as well as I.A.No. 15267/2025 in Writ Petition No. 4874/2024 were filed before the Hon’ble High Court, Mumbai. As per the directions given by the Hon’ble Chief Minister, legal advice of the Hon’ble Advocate General, Maharashtra State was obtained. The Hon’ble Advocate General, Maharashtra State has given legal advice that the Petitioners in the pending Writ Petitions before the Hon’ble High Court, Mumbai have prayed for the relief under Government Resolution Dt. 28.01.2022, in as much it was not extended to them; hence, any judicial action or the orders passed in the Writ Petitions pending before the Hon’ble High Court, Mumbai would not be an obstacle in withdrawing the Government Resolution Dated 28.01.2022.
In the matter of Service Accommodation of the Government officers/employees, the Hon’ble Supreme Court in Civil Appeal No. 6619/2014 viz. Union of India and others V/s Omkar Nath Dhar has recorded a finding that – “The right to shelter does not mean right to government accommodation. The government accommodation is meant for serving officers and officials and not to the retirees as a benevolence and distribution of largesse”. Moreover, in this regard, the Department of Law and Judiciary has recorded its opinion that the Government has no statutory duty to provide residential accommodation on ownership basis to its officers, nor the Government officers/employees have any statutory right to claim residential flats on ownership basis. Pursuant to the Government Resolution Dt. 28.01.2022, representations have been received from the officers/employees residing in Government Service Quarters in Mumbai and elsewhere, seeking flats on ownership basis in lieu of Service accommodation. If such demands are acceded to, Redevelopment Projects would not remain financially viable. Moreover, service accommodation would not be available for the employees newly joining service.
In view of all these factors, the Government contemplated the proposal of reconsidering and revoking the Government Resolution regarding allotment of ownership basis of a flat to the Government officers/employees residing in Service Quarters in lieu of their Service Accommodation. Accordingly, the Government has resolved as hereunder:-
Government Resolution:-
The Government Resolution Dt. 28.01.2022 regarding Redevelopment of B.D.D Chawl at Worli, which envisages allotment on ownership basis of a Redevelopment tenement admeasuring 500 Sq. Feet as part of Redevelopment of B.D.D Chawls, to those of the Government officers-employees residing in their Service Quarters in Saoli Building as on 28.01.2022 and also residing therein as on 01.01.2011, hereby stands revoked.
2. Apart from the Redevelopment of Worli B.D.D Chawls, Saoli Building, 8 unauthorised tenements in the complex of Saoli building and the adjacent 7 Baitha Chawls should be redeveloped and in lieu thereof, the tenements as per entitlement in the form of Service Quarters should be handed over to the General Administration Department/Public Works Department.
3. This Government Resolution has been made available on the website of the Government of Maharashtra viz. www.maharashtra.gov.in and its Code Number is 202507291632012009. This Government Resolution is attested and issued under Digital Signature.
