Preface:-

        Various licences, certificates and Government facilities are furnished to citizens by Government Offices, Local Self-Government Bodies etc. For this, affidavits in the prescribed formats are required to be furnished along with applications. Moreover, copies of the original documents as attested by Gazetted Officers/Special Executive Officers/other competent officers are required to be furnished. Hence, with a view to addressing the inconvenience caused to the citizens the Government has resolved to implement wherever possible, a single modus operandi for the acceptance of self-declaratory certificate and self-attested copies in lieu of affidavits, certificates and attested copies in Government offices.   

Government Resolution:-

        For obtaining various certificates, licences and other Government services/facilities from all Government offices under the control of Maharashtra Government, Local Self-Government Bodies and other Government Institutions etc., the citizens are required to furnish affidavits as well as copies of the original certificates/documents as attested by Gazetted Officers/Special Executive Officers and other Competent Officers. As a result, the citizens suffer inconvenience. To address this inconvenience, the Government has resolved to streamline the prevailing procedure in that regard.  

        Now in suppression of the above referred Government Resolution, the following directions are hereby issued for the acceptance of self-declaration in lieu of affidavits and self-attested copies in lieu of attested copies of the certificates/documents in all Government offices, Local Self-Government Bodies and other Government institutions etc. 

            (a) Acceptance of Self-Declaration in lieu of Affidavit:-

        During the course of Government business and for services/facilities, affidavits together with applications are demanded by several Government Offices. Wherever the existing Acts/Rules require affidavits along with applications, it would be necessary to furnish an affidavit. However, where such an Affidavit is not mandatory, affidavit should not be insisted upon. In all such cases, Self-declaration in lieu of Affidavit should be obtained. Self-declaration shall be as per Annexure-A.   

            (b) Acceptance of Self-attested copies in lieu of attested copies of original certificates/documents:-

        During the course of Government business and for government services/facilities copies of original certificates/documents are accepted with the application when they are attested by Gazetted Officers/Special Executive Officers/other Competent Officers. Wherever the existing Statutes/Rules require such attested copies, it would be necessary to furnish such attested copies. However, where such kind of attestation is not mandatory, in all such cases self-attested copies should be accepted. Then attested copies should not be demanded. However, a self-declaration regarding the veracity of self-attested copies should be obtained in Annexure-B, enclosed herewith.

            (c) Both the above self-declarations may be executed on plain paper and Judicial paper would not be required therefor.

            (d) The terms and conditions of the application in prescribed form should clearly mention that if any citizen furnishes erroneous/false information on the self-declaratory certificate, appropriate action under the provisions of the I.P.C as well as other statutes would be taken against the concerned citizen.

            (e) The Self-declaratory Certificate should carry a very clear and recent photograph of the concerned citizen. If available, Aadhar No. of the concerned citizen too should be mentioned therein.

        3. Public Facilitation Centre:-

            (a) All Public Facilitation Centres, Maha-E-Services Centres, Setu Centres etc. should act by accepting Self-declarations, Self-attested copies of the documents and Self-declarations regarding their veracity as per paragraph No.2 above.

            (b) Self-declaration in lieu of affidavit and self-declaration vis-à-vis the self-attested copies shall form part of the application. They should be obtained on a plain paper and Judicial paper would not be required therefor.

            (c) The Maha online should carry out necessary modifications to the computerised system developed for the services rendered by Public Facilitation Centres, Mah E-Services Centres and a report in that regard should be forthwith submitted to the Information & Technology Department.

        4. All administrative departments in Mantralaya should immediately direct their subordinate offices to act as above.

        5. This Government Resolution is issued with the concurrence of the Departments of Information & Technology and General Administration.

        6. This Government Resolution is made available on the website of the Government of Maharashtra viz. www.maharashtra.gov.in and its Code Number is 201503091825002707. This order is attested and issued under digital signature.
