            Vide.— Circular No. Griha Nirman/Gala Tabdil Fee/89/ dated 27/11/1989, issued by Commissioner of Co-operation and Registrar, Co-operative Societies, Maharashtra State, Pune.

            Whereas on 02/07/2001, the Commissioner of Co-operation & Registrar, Co-operative Societies, Maharashtra State, Pune sanctioned the Model Bye-laws prepared for the Co-operative Housing Societies and as mentioned in Bye-Law No. 38(E) 9 of the said Model Bye-Laws, the powers to decide the maximum rates of premium which are charged for the transfer of flat/premises in a co-operative housing society have been assigned to the Co-operation and Textile Department of the State Government.

            Whereas, the Commissioner of Co-operation and Registrar of Co-operative Societies, Maharashtra State, Pune vide his Circular No. Griha Nirman/Gala Tabdil/Fee/89, dated 27/11/1989 had determined the rates of premium, but as the present circumstances necessitate the revocation of the relevant circular and issuance of order in that regard by the State Government, the Government has decided to issue the appropriate orders regarding the levy of premium for transfer of flat/premises in a Co-operative Housing Society, in that context.

ORDER

            In the exercise of the powers conferred upon the State Government under section 79-A of the Maharashtra Co-operative Societies Act, 1960, following orders are hereby issued in the larger interests of the people in the State.

            1] Circular No. Griha Nirman/Gala Tabdil/Fee/89, dated 27/11/1989 issued by the Commissioner of Co-operation and Registrar, Co-operative Societies, Maharashtra State, Pune is hereby revoked.

                 2] The rate of premium to be charged for the transfer of Flat/Premises as well as the rights and share in the share capital/property of the Co-operative Housing Society by a member in favour of another, should be determined at the General Meeting of the Society.

            However, under no circumstances the premium rates determined at the General Meeting of the Society, shall exceed the maximum rates which are set out herein below:-

1] Municipal Corporation and Authority Area 25,000/-
2] “A” Class Municipality 20,000/-
3] “B” Class Municipality 15,000/-
4] “C” Class Municipality 10,000/-
5] Village Panchayat (Rural Area) 5,000/-

            The said orders shall come into force immediately.

            By the order and in the name of the Governor of Maharashtra.
