Preface:-
As per Section 52(1)(i) of the Maharashtra Village Panchayat and Maharashtra Regional and Town Planning (Amendment) Act, 2014 (Maharashtra Act No.43 of 2014), where any person in any village, for which a Model Regional Plan or a Final Regional Plan has not been published or does not exist as per the provisions of the Maharashtra Regional and Town Planning Act, 1966, desires to carry out construction outside Gaothan area of such village, he would be required to take prior permission of the Panchayat and such permission is to be accorded by the Panchayat only after taking prior approval of the Town Planning Officer of the State Government who is posted at the level of Panchayat Samiti or where such officer is not so posted at the level of the Panchayat Samiti, then with the prior approval of the Town Planning Officer at the level of Zilla Parishad.
The applications of all those persons who wish to carry out construction as per the above provisions are required to be forwarded to the Town Planning Officer posted at the level of Panchayat Samiti through the Village Panchayat (presently, the Town Planning Officer at the district level) and as such the number of applications that would be received by such officer from the entire district would be mammoth. Having regard to the applications that would be received by such Town Planning Officer and in order to ensure that no undue delay is caused in the receipt of building permission for the construction of houses of individual nature on small sized authorised plots, the Government contemplated the matter of granting building permission at the level of Village Panchayat in respect of constructions on small plots situated outside the Gaothan area of the villages which are not covered by the Regional Plan, along the lines of instructions issued to District Collectors under Government Circular in the Department of Urban Development, dt. 03.01.2015 regarding grant of expeditious building permission on the basis of Standardised Specimen Building Plans in favour of small sized authorised plots. If applications for the sanction of building plans are made as per such Standardised Building Plans it would save office time in the technical scrutiny of such applications and facilitate an early disposal of such building permission cases and as such, it would be possible to grant an expeditious permission. In that view of the matter, the Government hereby issues the following instructions to all Village Panchayats as hereunder:-

Expeditious building permission in respect of the below mentioned small sized authorised plots situated outside the Gaothan area of the villages not covered by Regional Plan on the basis of Standardised Specimen Building Plan should be permitted as per the Guidelines issued under Circular in the Department of Urban Development bearing No.TPS.1813/3200/Pra.Kra.520/13/Circular/UD-13, Dt.03.01.2015.

For an easy reference, the circular in the Department of Urban Development, bearing No.TPS.1813/3200/Pra.Kra.520/13/Circular/UD-13, Dt.03.01.2015 is enclosed herewith. If the concerned plot-holder selects appropriate specimen plan from the aforesaid Standardised Specimen Building Plans and makes an application for the grant of building permission, complete in all respects in the specimen prescribed under APPENDIX-A, then the concerned Village Panchayat should take an appropriate decision regarding sanction of building permission in its monthly meeting immediately following the date of receipt of the application.
