Preface:-
While effecting transfer of Residential flats under the Slum Rehabilitation Authority under the Slum Rehabilitation Authority, it is mandatory to get the instrument of transfer registered and as per the provisions of Circular No.145 of the Slum Rehabilitation Authority, Mumbai Dt. 24.10.2013, for such registration Transfer Fees of Rs. 1 Lakh are charged for such residential flats.
Slum Rehabilitation Flats are allotted free of cost to poor hut holders with a view to providing them shelter. Upon transfer of such flats amount of stamp duty is required to be paid to the Government. Furthermore, the amount of stamp duty or Rupees 1 Lakh, whichever being more, has to be deposited with the Government towards transfer fees. Hence, for the very same thing, the citizens are required to pay to the Government both the fees viz. stamp duty, as well as Transfer Fees. Consequently, the persons purchasing Rehabilitation Flats have to bear financial loss. Hence, the Government contemplated the matter of reducing the amount of Transfer Fees fixed by the Slum Rehabilitation Authority, vide its Circular No:-145 while effecting transfer of residential flats under Slum Rehabilitation Scheme.
Government Resolution:-
The Transfer Fees of Rs. 1,00,000/- fixed by the Slum Rehabilitation Authority under its Circular No. 145 for the transfer of residential rehabilitation flats allotted under Slum Rehabilitation Scheme after the prescribed period is now fixed at Rs. 50,000/-.
In the matter of industrial and commercial tenements the provisions pertaining to Transfer Fees stipulated by the Slum Rehabilitation Authority under its Circular No:- 145 Dated 24.10.2013 shall be applicable.
These provisions shall be applicable to Slum Rehabilitation Authority, Mumbai and Mumbai Metropolitan Region Slum Rehabilitation Authority, Thane.
