Preface:-
Under Regulation 16 of the Maharashtra Housing and Area Development (Disposal of Lands) Regulations, 1982, various co-operative housing societies have been allotted plots for residential purpose by the MHADA with the approval of the Government. Under the above referred Government Letter Dated 18.12.1996 instructions have been given that as and when MHADA lands shall be allotted to the proposed co-operative housing societies under Regulation 16, 10% of the flats generated on the plots so allotted shall be reserved for the Government Nominated Government Officers/Employees and that such persons shall be selected at the Government Level. As per the findings recorded by the Hon’ble High Court in its Order Dated 20.03.2014 passed in the Petition of Shri. Chandrabhan Sukhdev Sangle and others versus the Department of Urban Development and others (Petition No.882/2011), filed before the Hon’ble High Court, it would not be proper to make direct allotment of government property to any person individually. In order to maintain transparency and to afford equal opportunity to all it is imperative to publish an advertisement, so that government property can be allotted to the eligible persons from the Applications, so received. In view of the findings recorded by the Hon’ble High Court in its aforementioned Order Dated 20.03.2014, the Government contemplated the matter of allotting 10% flats under Government Share, as stated above. In furtherance thereof, the Government has resolved as hereunder:-

Henceforth, 10% flats to be made available to the Government out of the flats generated on the plots allotted by the MHADA with Government sanction to various co-operative housing societies under Regulation 16 of the Maharashtra Housing and Area Development (Disposal of Lands) Regulations, 1982 should be allotted only to the working Government Officers/Employees through a Draw to be published by the MHADA under Advertisement. While transferring such flats on ownership rights by sale to the Government Officers/Employees declared successful in the Draw, the cost of construction of such flats should be charged from them.
2. The co-operative housing societies which are allotted plots under Regulation 16, should hand over to the MHADA the flats to be made available under 10% Share of the Government and apprise the Government in that regard. The MHADA should maintain a separate co-operative housing society-wise Register for 10% flats to be made available under Government Share, as stated above.
3. While allotting 10% Government Quota Flats to be allotted under Regulation 16 to the In-Service Government Officers/Employees, the procedure which is regularly adopted by the MHADA while publishing its Draws, should be followed and the Terms and Conditions which are prescribed for the Category of Government Officers/Employees should be made applicable.
4. The Advertisements published for the allotment of 10% Quota Flats made available to the Government under Regulation 16 should clearly state such facts, so that distinction of such Advertisement from the Advertisements ordinarily published by the MHADA vis-à-vis Government Officers and Employees, would be clear.
5. As and when, the MHADA lands shall be allotted to the proposed co-operative housing societies under Regulation 16, 10% flats under Government Share out of the flats generated on such allotted plots should be allotted to in-service Government Officers and Employees by following the aforesaid procedure.
6. This Government Resolution has been made available on the website of the Government of Maharashtra viz. www.maharashtra.gov.in and its Code Number is 202408301059252509. This Government Resolution is attested and issued under Digital Signature.
