Decentralisation of Powers for sanctioning various Licenses under the State Excise Duty Department

Preface:-
The State Excise Duty Department is the Revenue Department of the State Government. This Department has the powers to sanction various licenses pertaining to liquor, alcohol, as well as the raw material required therefor, as per the provisions of the Maharashtra Prohibition Act, 1949. After expansion of the industry in the state, the units which use liquor and alcohol, as well as the raw material required therefor, as controlled by the State Excise Department for various industrial reasons, have upgraded their production capacity for maintaining their supply in proportion to market demand. To meet demands from such units and to encourage the industries functioning in the state of Maharashtra under the Make in India Policy of the Central Government, to set up new industry in the State for the generation of employment and to minimize the inconvenience caused to the entrepreneurs and the common public, it is imperative that the administrative delays in obtaining permissions at various levels, should be avoided. As such, the Government contemplated the matter of decentralizing the powers of sanctioning various licenses granted by the Department of State Excise Duty in order to make its working more and more public-oriented and efficient and providing an industry friendly climate to liquor producing and liquor selling industry in the State.
Government Resolution:-
In furtherance of the provisions of the Maharashtra Prohibition Act, 1949 and in order to curtail the period required for the sanction of various licenses pertaining to liquor, alcohol, as well as the raw material required therefor, which are controlled by the State Excise Duty Department, the powers in that regard stand decentralized as set out herein below:-

| Licenses Regarding Molasses:- | ||
| 1 | M-1 | The concerned Collectors shall have the powers to grant Licenses. |
| 2 | M-2 | For the sanction of additional quota required by animal feed producing units for their molasses requirement, decision should be taken at the level of the Divisional Deputy Commissioner, State Excise Duty by sanctioning additional annual quota of 2000 Metric Tonne of molasses after recommendation by the District Animal Husbandry Officer and District Industries Officer from the concerned district, in that regard. Furthermore, for sanctioning Ad-hoc quota equal to two months quota of molasses, decision should be taken at the level of the Superintendent of the State Excise Duty. |
| Liquor and Alcohol Licenses:- | ||
| 1 | RS-1 | The concerned Superintendent of the State Excise Duty shall have the powers to grant such License. |
| 2 | RS-2 | For sanctioning Industrial Alcohol License (RS-2) or for permitting additional units over and above the alcohol sanctioned under such License, the powers up to 5 Lakh Litres per annum, are hereby conferred upon the Collectors. |
| 3 | RS-6 and RS-6(A) | The concerned Superintendents of the State Excise are delegated the powers to grant such Licenses. |
| 4 | RS-7 | The concerned Divisional Deputy Commissioners are delegated the powers to grant such Licenses. |
| 5 | DS-5 | The powers to fix the quota of denatured alcohol pertaining to DS-5 License of Industrial denatured alcohol or for permitting additional/surplus units over and above the sanctioned alcohol, the concerned Collectors shall have the powers up to 5 Lakh Litre per annum. |
| 6 | DS-6 | The powers to grant License are delegated to the concerned Divisional Deputy Commissioners. |
| 7 | DS-7 | The powers to grant such License are delegated to the concerned Inspectors of State Excise Duty. |
| 8 | DSP-1/ DSP-2/ DSP-3 | The powers to grant such License are delegated to the concerned Superintendents of the State Excise Duty. |
| License for Wholesale:- | ||
| 1 | FL-1 | The powers to grant such License are delegated to the concerned Superintendents of the State Excise Duty. |
| 2 | FLW-1 | With prior permission of the Government, the concerned Superintendents of State Excise Duty shall have the powers to grant such License. |
| License for Retail Sale:- | ||
| 1 | FL-4 | The powers to grant such License are delegated to the concerned Superintendents of State Excise Duty. |
| 2 | FLW-2 | Subject to prior permission of the Government, the powers to grant such License stand delegated to the concerned Superintendents of the State Excise Duty. |
| 3 | FLBR-2 | Subject to prior permission of the Divisional Deputy Commissioners, the powers to grant such License stand delegated to the concerned Superintendents of the State Excise Duty. |
