Memorandum of Mortgage by Deposit of Title Deeds

            ABC, the “Mortgagor” herein, hereby makes a Memorandum regarding Mortgage by Deposit of Title Deeds at_______, this___ day of_______ 20___ as follows:-

ABC, an adult Indian, aged about____ years, occ:- Service, resident of_________________________, the “Mortgagor” herein has deposited with DEF, a co-operative bank having its registered office at_____________________ and branch office at__________________ (the “Mortgagee Bank”), all the original title deeds in his possession and power pertaining to his flat admeasuring about_______ square feet (carpet), being and situate at_______________________ (the “Said Flat”) in consideration of a housing loan of Rs______/- (Rs______________________ only) lent and advanced by DEF, the “Mortgagee Bank” vide a Banker’s cheque dated_______, bearing no.____________, issued by the Manager of the “Mortgagee Bank” and the said loan amount has already been disbursed to XYZ, the Developer having his office at________________, who  has sold the “Said Flat” to ABC, the “Mortgagor” under an Agreement for Sale executed and registered in the office of Sub-Registrar______, vide Sr.No______, pages nos._______, volume______, dated_________.

Description of the “Said Flat” is narrated in the Schedule of Property appended hereto and the original title-deeds deposited with the “Mortgagee Bank” are described in the Schedule of Title Deeds.

ABC, the “Mortgagor” has deposited the original title-deeds with a view to creating a charge and security in favour of the “Mortgagee Bank” for the repayment of the housing loan of Rs____/- (Rs___________________ only) with simple interest @_____ % p.a. which is to be repaid within a period of______ years, commencing from the date of Loan Agreement viz. _______ and the EMI (Equated Monthly Instalment) thereof is Rs______/- (Rs___________________ only).

ABC, the “Mortgagor” herein hereby agrees and undertakes to execute and register a proper Deed of Mortgage pertaining to the aforesaid loan transaction in favour of the “Mortgagee Bank” if the circumstances so require, as and when the latter party calls upon him to do so, in such form and with such covenants as the circumstances of the case may reasonably require and the cost thereof would be borne equally by both the parties hereto.
