Preface:-

            During the years 1950 and 1960, the Government with a view to creating affordable houses in the areas of Mumbai City and Suburbs, developed 56 colonies through Mumbai Board of the Maharashtra Housing and Area Development Authority (MHADA). These colonies comprise an estimated 5,000 co-operative housing societies. As construction of these buildings is 50 to 60 years old and some of the buildings have become old and dilapidated, their development for raising the standard of living of the residents has become a matter of urgency for such residents.   

             A Consolidated/Cluster Redevelopment is undertaken as per the provisions of the Development Control Regulations for Greater Mumbai. In the event of composite Redevelopment, it would be possible to secure a planned development of the infrastructural facilities and appropriate planning of the area and it would also be possible to obtain basic/modern amenities, benefits of larger and planned houses, safe flats equipped with more space and advanced amenities in place of old, small and degraded buildings. Modern design and environment friendly construction would complement environment of the city. Hence, for the creation of world class amenities and buildings during the course of Redevelopment of the MHADA Colonies, Consolidated Redevelopment of the entire Layout is essential. In view of this, the Government pursuant to the Proposal received from the MHADA, vie its Letter Dt. 02.07.2025, contemplated the matter of carrying out Redevelopment of a MHADA Layout at Sardar Vallabhbhai Patel Nagar (S.V.P. Nagar), Andheri through a Construction & Development Agency.

Government Resolution:-

            Save and except the plots in the MHADA Layouts at Sardar Vallabhbhai Patel Nagar (S.V.P. Nagar), Andheri on which Redevelopment Permission is already granted to the co-operative housing societies, for the Consolidated/Cluster Redevelopment of the remaining buildings in the Layout, the Government has resolved as hereunder:-

                 (1) Save and except the plots in the MHADA Layout at Sardar Vallabhbhai Patel Nagar (S.V.P. Nagar), Versova, Andheri on which Redevelopment Permission is already granted to the co-operative housing societies , sanction is hereby granted for undertaking Consolidated/Cluster Redevelopment Project for the buildings in the remaining Layout as per the provisions of Regulation 33(9) by appointing a Construction and Development Agency (C&DA).     

                 (2) While implementing this Project under Regulation 33(9), a Built-up Area of 74,760.95 Sq. Mt. (inclusive of fungible area) is permitted under clause 20 of Regulation 33(9) in the form of housing stock and by admitting such housing stock as the minimum basic parameter, sanction is hereby accorded for extending Redevelopment Permission to the Bidder who gives the highest housing stock to the MHADA and also fulfills the financial and physical terms of the Tender.

                 (3) While sanctioning aggregate Built-up Area on this Layout, sanction is hereby accorded under the provisions of Regulation 33(9), to compute the total admissible Built-up Area on the Layout by deducting Built-up Area sanctioned for some of the buildings in the Layout, if the MHADA has already sanctioned their Redevelopment.  

                 (4) As per Resolution No. 6330 of the MHAD Authority, Dated 20.09.2008 (for the floor space accruing through other modes) sanction is hereby accorded for the payment of premium by the C&D Agency at the rate of 5% of the Ready Reckoner Rate.

                 (5) For the inclusion of buildings, which have not completed the period of 30 years, in the Redevelopment Project for facilitating Consolidated Redevelopment of this Layout, decision is permitted to be taken at the MHADA Layout as per the provision of clause 1.2 of Regulation 33(9).

                 (6) As per the Government Notification Dated 23.05.2018, the MHADA has been appointed as the Planning Authority for 114 Layouts under the control of Mumbai Board of the MHADA; hence, sanction is hereby accorded to the effect that the MHADA shall act as the Planning Authority for the captioned Redevelopment Project to be implemented under Regulation 33(9).

                 (7) The appointment of C&D Agency is to be made by the MHADA through Tender System. Hence, sanction is hereby granted to the effect that the Government Circular bearing No:- SaGruYo-2018/Pra.Kra.85/14-Sa, Dt. 04.07.2019 issued under Section 79A of the Maharashtra Co-operative Societies Act, 1960 shall not be applicable.  

                 (8) The Consolidated/Cluster Redevelopment of this Layout is to be undertaken by a C&D Agency finalised by the MHADA by following Tender System. Hence, sanction is hereby accorded to the effect that it shall not be necessary to obtain Consent Letters from the residents for the said Project under clause 4a. of Regulation 33(9).

                 (9) Sanction is hereby accorded for carrying out Rehabilitation of the existing residents in the component comprising Rehabilitation Floor Space flats in terms of Clause 5 of Regulation 33(9).

                 (10) The responsibility of carrying out Rehabilitation of the existing residents comprised in the Project, providing them Monthly Rent or making arrangements for their alternative accommodation and Corpus Fund, as well developing infrastructural facilities on the Layout, shall rest upon the C&D Agency to be appointed for the Redevelopment Project.

                 (11) Under Regulations 33(9), the permissible Built-up Area of a Redevelopment Project consists of Rehabilitation Area, as well as Saleable Component Area. From the perspective of planning, permission should be granted for allowing separate share of land and separate buildings under the Rehabilitation Component and Saleable Component. However, where separate sub-division is proposed, the MHADA, in its capacity as the Planning Authority, should take appropriate care to ensure that the plot-wise Floor Space Index will not be imbalanced.

                 (12) Sanction is hereby granted permitting the criteria of eligibility governing authorised residents and encroachers comprised in the said Redevelopment Project to be fixed at the level of MHADA, in conformity with the provisions of Regulation 33(9).

                 (13) Sanction is hereby accorded for the constitution of a High Power Committee, as set out hereunder, for ensuring speedy and appropriate implementation of the said Project and for finalising Terms and Conditions of the Tender and other financial matters:-

                 (14) The Recommendations to be received from the aforesaid High Power Committee presided over by the Additional Chief Secretary/Principal Secretary, Department of Housing should be submitted for the sanction of the Government and as per necessity, and appropriate decisions should be taken with the concurrence of the Department of urban Development and the sanction of the Government. Review of the work done in the Redevelopment Project and its progress should be conducted by the High Power Committee once in 4 months.

                 (15) There are various existing co-operative housing societies on the aforesaid Layout. Hence, a Grievance Redress Committee should be set up at the level of the MHADA for the timely resolution of the existing problems, if any, of the local residents and co-operative societies concerning the Consolidated Redevelopment of this Layout or the difficulties which may arise in future, so as to ensure that these problems would not have any adverse effect on the Consolidated Redevelopment of this Layout.

                 (16) A Consolidated/Cluster Redevelopment is to be undertaken on this property. Hence, planned Redevelopment of the infrastructural facilities, therein, is equally important, which is possible in the Consolidated/Cluster Redevelopment; hence, proposals for the Redevelopment/Self-Redevelopment of any standalone buildings from this Property should not be taken into consideration.  

                 (17) The Department of housing shall have the powers to make any ancillary changes, if they are so warranted by the implementation of this Resolution.

            2. This Government Resolution has been issued pursuant to the decision taken by the Hon’ble Cabinet in its Meeting Dt. 23.09.2025.
