Preface:-
The Central Government, with a view to regulating the employment and conditions of service of the workers working in the field of building and other construction work, providing for their security and health and in general to undertake welfare measures for them, had enforced the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. In furtherance thereof, and for the implementation of the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, the Maharashtra Building and other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2007 came to be framed. Under Section 18 of the said Act, the Maharashtra Building and other Construction Workers Welfare Board was established in the State.
Under Section 3(1) of the Building and other Construction Workers Welfare Cess Act, 1996, the Central Government, vide its Notification Dated 26.06.1996 has fixed a cess to the extent of 1% of the total Project Cost (excluding the land value). Accordingly, the workers working in the building and other construction work field in the State are registered and renewed by the Board and various Welfare Schemes are implemented by the Board from the cess fund credited with the Board for the construction workers whose Registration is active (alive).
The Central Government had repealed 29 Labour Laws and enforced four new Labour Codes throughout the country with effect from 21.11.2025. Under these Codes, the Acts at Reference Nos. 1 and 2 have been repealed and now the matters pertaining to the welfare of Building and other Construction Workers have been incorporated in the “Code on Social Security-2020”.
Section (7)(6) of the said Code set out the matters which require implementation of various Welfare Schemes for the construction workers. Accordingly, Section (7)(6)(b) containing a provision to the following effect – “make payment of pension to the beneficiaries who have completed the age of sixty years”.
Pursuant to the said provision, the Board in its Meeting, Dated 12.05.2026 passed a Resolution and submitted to the Government a Proposal for enforcing a Pension Scheme for the Registered Construction Workers of the Board, vide Reference No. 9 above. Upon completion of 60 years of age, a construction worker is not registered with the Board nor his previous Registration renewed. Consequently, the worker is deprived of various schemes started by the Board. In such event, the Government, with a view to extending a helping hand to such worker for making his life in old age bearable by offering him some assistance, contemplated the matter of discontinuing the ongoing Pension Scheme started by the Board for the Registered Construction Workers and enforcing a Revised “Pension Scheme” as per the aforesaid provision of the Code on Social Security.
Government Resolution:-
Sanction is hereby accorded under this Government Resolution to revoke the former Pension Scheme implemented by the Maharashtra Building and other Construction Workers Welfare Board, Mumbai for its registered workers and to start a Revised “Pension Scheme” under the aforesaid provisions of the Code on Social Security, which would pay them a Pension of Rs. 12,000/- each year, upon completion of 60 years of their age.
(1) Eligibility Criteria for the Pension Scheme:-
