Preface:-
The State of Maharashtra enjoys a long tradition of very rich folk arts and traditional occupations. The Potter Community forms an integral part of this tradition and through the medium of its artistic skills, this community has contributed immensely to the Rural and Urban economies over several generations. The art of making utensils from earth is not only an occupation, but also an integral part of our culture. However, due to changing global currents and the ever increasing use of plastic, as well as ceramic articles, the demand for the traditional articles made from earth has decreased. As a result, the families dependent upon this occupation face a big problem of their very survival. In the current times, the artisans have to face the main challenges of the unavailability of raw material, lack of modern technology, lack of market and financial assistance etc. Furthermore, it has become necessary to supersede the instructions issued under the Government Circulars at Reference No. 2, Dated 28.08.2009 and Reference No. 6, Dated 21.01.2019. In view of these factors, the Government contemplated the matter of laying down an all comprehensive Policy in the Department of Revenue to resolve the difficulties faced by the persons from the Potter Community, while pursuing their traditional occupation. Against this backdrop, the Government has resolved as hereunder:-
Government Resolution:-
With a view to providing incentives to the families from the Potter Community pursuing their traditional occupation, the instructions issued under the Government Circulars at Reference No. 2, Dated 28.08.2009 and Reference No.6, Dated 21.01.2019 are hereby superseded and the following directions are hereby issued to all concerned District Collectors, Sub-Divisional Officers and Tahsildars, as set out hereunder:-
[A] Exemption in Royalty:-
(1) The provisions of Rule 4 of the Maharashtra Land Revenue (Extraction and Removal of Minor Minerals), Rules, 1968, are as hereunder:-
Rule 4. Excavation for Brick Manufacture etc.—
Subject to the provisions of Rule 5, with the previous permission in writing of the Tahsildars or Naib-Tahsildar and without payment of any Fees or Royalty, any ancestral potter family or maker of bricks or tiles, may, for the purpose of his profession, remove earth from bed of the sea, or from the bed of any creek, river, any nalla or from any unassigned private land under Section 22 or Government waste land, up to the limit of 700 brass per year.
As per the Rules framed under the Mines and Minerals (Development and Regulation) Act, 1957 (Act 67 of 1957) or the Acts for the time being in force, Royalty shall be charged on the extraction of earth exceeding 700 Brass. For availing of this benefit, a person from the ancestral potter community would be required to obtain an Identity Card to that effect, from the Tahsildar.
(ii) For the purpose of the aforesaid Sub-Rule of the Maharashtra Land Revenue (Extraction and Removal of Minor Minerals) Rules, 1968, the expression “Ancestral Potter Family” should be construed as including the husband or wife of a person from the ancestral potter community, their minor children below 18 years of age and accordingly, such family shall be eligible to obtain a benefit under the aforesaid Rules.
(iii) The limit of unit mentioned in the aforesaid Rule shall be available for one year in case of the ancestral potter family, as mentioned above. Such benefit shall be permissible in favour of only one person from the family.
(iv) As stated in Rule 4 of the Maharashtra Land Revenue (Extraction and Removal of Minor Minerals) Rules, 1968, only Royalty will be exempted within the limit up to 700 Brass of earth, which is a minor mineral. However, it would be mandatory to pay the contribution to the District Mineral Foundation Fund and other charges in proportion to the extent of extraction.
(v) Where permission for the extraction above the limit of 700 Brass of earth is required, it would be necessary to pay the entire Royalty above 700 Brass limit, as well as contribution to the District mineral Foundation Fund and other charges.
(vi) In view of the above referred Government Resolution at Sr. No.2, Dated 03.11.2010, where the families from potter community traditionally engaged in such occupation require silt/earth from the village ponds, barrages, percolation tanks and catchment areas, up to the limit of 700 Brass Units for their own occupation and they are ready to remove such silt/earth at their own expense, then Royalty will not be charged. However, it would be necessary to obtain No-Objection from the concerned Departments. Nevertheless, it would be necessary to pay the contribution to the District Mineral Foundation Found and other charges.
(vii) The concerned Tahsildar should obtain from the persons within their Talukas, engaged in the occupation of pottery, the information concerning the probable lands from where the earth would be made available to the persons from the potter community for the purpose of their traditional occupation and thereafter they should submit to the District Collector’s office, a complete proposal, along with the necessary documents for the inclusion of such lands in the District Minor Minerals Plan. However, in case of the village ponds, percolation tanks, barrages, catchment areas, as well as water conservation projects, as well as the tanks of the Water Resources Department, where lands/areas are earmarked for the extraction of silt/earth under Rule 58, it shall not be necessary to include them in the Mining Plan.
(ix) In some places, earth would be made available to the persons from the potter community from the areas owned by private persons. In such event, it would be necessary to include the Survey Number of such area in the District Mining Plan. If permission for the extraction of earth from the areas of private persons is required, it would be mandatory to furnish the Letter of Consent of such private owner. In such case, Royalty up to 700 Brass Unit would be exempted. Nevertheless, the Applicant would be obliged to pay the Application Fees, contribution to the District Mineral Foundation Fund and other charges. Moreover, in case of demand for consideration made by the owner of such private area, the entire responsibility to pay such consideration shall rest upon the concerned Applicant.
(x) For carrying out extraction of earth from the areas earmarked within the PESA Areas, it shall be mandatory to obtain the recommendations of the Gram Sabha from such Scheduled Area, as per the provisions of the Panchayats (Extension to the Scheduled Areas) Act, 1996.

(iv) Potter quarries were reserved to facilitate extraction of earth by the potters. However, in some places, due to encroachment, their existence has been obliterated. If inspection of Record establishes that existence of such quarries was obliterated due to encroachment, then the concerned District Collector should take steps for the removal of such encroachments. Moreover, the Divisional Commissioner should conduct a Review in this regard, from time to time.
[H] Non-Agricultural Permission:- Presently, the Maharashtra Regional and Town Planning Act, 1966 permits the use of agricultural land for operating a Brick Kiln. Hence, for a use which is already permitted under the Act, a separate Non-Agricultural Permission from the District Collector, as per the provisions of the Maharashtra Land Revenue Code, 1966 would not be required.
[I] Brick Kiln:-
The traditional occupation of the potter community has been linked with earthen art and pottery. Since the dawn of human civilization, the potter fraternity has been making several types of articles required in day-to-day life, farming and festival, with their hands and wheel (potter’s wheel). Their traditional occupation includes utensils required in daily life and kitchen, for instance, small and big sized earthen bins (Ranjan) and matkas, for chilling drinking water, utensils for cooking, churning of buttermilk or for preparation of curd, earthen pans for roasting bhakri and woks (Khapar), as well as big sized earthen silos for the storage of grain. Moreover, it also includes toys and ornamental articles, used on religious occasions and festivals [idols, earthen lamps, diwali miniature forts, small earthen pots (Ghats and Sugads, as well as articles used by various castes and tribes for performing their rituals), miscellaneous articles used during wedding (earthen pillars/pots) and small water pots used for cremation.]
Since beginning, the articles such as roof tiles and bricks made by the potter community are used in the rural and traditional housing on a large scale. These articles made by the potter community are entirely natural and eco-friendly. Although, in modern times, the use of plastic and metal has changed the nature of this occupation, yet in view of the ever increasing extent of urbanization, demand for such bricks has seen a huge growth in the urban areas. Consequently, the importance of bricks is still relevant today. The kiln which is set up for baking the bricks during the manufacturing process is called “Aawa”. Generally, steps are taken to light this “Aawa” at the interval of three days. The Government of India, in its Ministry of Environment, Forests and Climate Change, vide its Notification Dated 22.02.2022 has issued instructions vis-à-vis the installation and operation of a Brick Kiln. In view of these instructions the Brick Kiln Holders who intend to use their Brick Kilns for commercial operations would be required to obtain permission from the Maharashtra pollution Control Board for operating a Brick Kiln of zig-zag and vertical shaft type.
However, in case of persons from the potter community who have been manufacturing bricks over several years by using traditional and environment friendly methods, from their Brick Kilns, with their output of bricks and the height of Brick Kilns lower than the parameters set by the Government of India in the Ministry of Environment, Forest and Climate Change vis-à-vis the Units of brick output and height of Kiln set out in its Notification Dated 22.02.2022 the provisions of the said Notification of the Government of India in the Ministry of Environment, Forest and Climate Change Dated 22.02.2022, would not be binding.
However, where Brick-Kilns of the families engaged in their traditional occupation are already functioning in the prohibited areas where commissioning of a Brick-Kiln is prohibited by various Authorities, the concerned Brick-Kiln Holders would be required to take precaution/ensure that the local citizens would not be inconvenienced, thereby. However, if a family engaged in traditional occupation intends to set up a new Brick-Kiln in a Prohibited Area, it cannot start it in the Prohibited Area, earmarked by the Local Municipal Corporations/Local Self-Government Bodies.
Moreover, the Tahsildars shall maintain separate entries and the ancillary Record of all Brick-Kilns in the Talukas.
[J] Availability of Ash from Thermal Power Plants:-
The Department of Energy, vide Government Resolution Dated 19.09.2025 has laid down a Policy viz. “The Policy for the Use of Ash from the Thermal Power Plants of Maha Generation Company in the State”. It inter-alia, groups the Thermal Power Plants in the State into Group A (Nashik, Bhusawal, Parli and Paras) and Group B (Koradi, Khaparkheda and Chandrapur). The ash generated from the Thermal Power Plants in these Groups would be allotted in the Ratio of 60:20:20. In other words, 60 percent ash would be allotted to the enterprises using it on large scale and 20 percent ash would be allotted to the micro, small and medium enterprises by following an Open Tender/E-Auction mode. On the other hand, the balance 20 percent (concessional rate) would be reserved for the local brick manufacturers/local micro and small enterprises and the Bodies of Project Affected Persons.
The Tahsildars and the Chief Engineers of the concerned Thermal Power Plants should take steps to provide ash sold under the 20 percent quota (intended for concessional Rate) at 50 percent concessional Rate of the Rate fetched by Group II (viz. micro and small industries) or the Base Price fixed for Group-II, whichever being more.
Moreover, the concerned Tahsildars and the Chief Engineers of the concerned Power Plants should take steps to provide ash at the concessional Rate fixed by the predecessor Directors of the Maha Generation Company for Group “A” and Group “B”, whichever is more.
If the Tahsildars certify the status of a Brick-Kiln as a conventional Brick-Kiln, the Thermal Power Plants should provide such Brick-Kiln with pond ash at the Rate of Rs. 100/- per tonne for eight months.
02. To facilitate implementation of this Government Resolution the concerned District Collector should take steps to issue additional supplementary orders.
This Government Resolution has been made available on the website of the Government of Maharashtra viz. www.maharashtra.gov.in and its Code Number is 202606101817178319. This Government Resolution has been attested and issued under Digital Signature.
