Preface:-

            The Central Government, in a National Workshop held on the 29th December, 2014 on the subject of ‘Make in India” has made 98 recommendations to the State for the implementation of “Ease of Doing Business” within the prescribed timeframe. In the World Bank Survey Report for the year 2015-2016 on the subject of “Ease of Doing Business” India stood at 130th spot and the Hon’ble Prime Minister has laid emphasis on the necessary measures which should be taken to improve India’s Rating in Top 50. Implementation of Single Window System for the grant of all sanctions required for setting up an industry in the state, is one of the major recommendations made by the Central Government in its Ministry of Trade and Commerce. In furtherance thereof, the Chief Secretary assured all dignitaries present at the “Make in India” Workshop regarding implementation of the Single Window System in the State. At the level of the Hon’ble Chief Minister and the Hon’ble Chief Secretary, review of the progress made by ‘Make in India” and “Make in Maharashtra” is being conducted.

            In order to improve India’s ranking in the World Bank Report on the Ease of Doing Business and to make “Make in Maharashtra” Programme successful, it is imperative that the procedure/phases pertaining to No-Objections and Permits of various Agencies required for setting up a particular industry and the timeframe required therefor, be curtailed. If “Single Window System” is implemented effectively this goal can be achieved. .

            The Central Government has laid down Guidelines containing Department-wise recommendations for streamlining the procedure for the grant of permits and sanctions of various departments, in order to promote climate conducive for industrial investment in the state in future. Based upon the progress of implementation of these recommendations, the process of awarding Progress-Index to the States started in July, 2015. Implementation of “Single Window System” is one such major recommendations and it will have impact by improving state ranking. In the findings of the Central Government for the year 2015 on the subject of Ease of Doing in all states, Maharashtra stood at eighth spot. Thereafter, the Central Government has released 340 department-wise recommendations and of these 36 recommendations pertain to implementation of Single Window System. Hence, in order to improve the ratings of the state for the year 2016 and to provide permits and No-Objections required by industries in Maharashtra in one place, it is imperative that the Single Window System be commissioned.

            In order to deliver transparent, efficient and timely public services to deserving persons in the state and in order to introduce transparency and accountability in Government Departments, Agencies and other Public Authorities delivering public service to deserving persons and for the matters connected ancillary thereto, an all comprehensive Act in the form of Maharashtra Right to Public Services Act was enacted, vide Government Notification dated 31/08/2015. The provisions of this Act, inter-alia provide for the disclosure of details of services delivered by each Public Authority, the time limit prescribed therefor and the appointment of Designated Officer and First and Second Appellate Authorities. Hence, an endeavor is being made to make Single Window System for industries more efficient and effective by resorting to the provisions of the Maharashtra Right to Public Services Act.

            The main object behind the ambitious programme of “Make in Maharashtra” is to introduce ease, efficiency and transparency in the Government procedure by making use of E-Forum, so that machinery granting sanctions required for setting up an industry can be reformed. This purpose can be achieved by implementing “Single Window System” by providing all permissions in one place, so as to facilitate new investment in the industrial sector of the state.

            The State declared its new Industrial Policy, vide Government Resolution dt. 22nd February, 2013. The State Government has started an Integrated Facilitation Centre contemplated by the Industrial Policy-2013, in order to assist investors. This Integrated Facilitation Centre is officially named as “Maharashtra Industry, Trade and Investment Facilitation Centre (Maitri)” and it started functioning in Mumbai from 27th February, 2014.

            In view of the aforesaid factual scenario, the Government contemplated the matter of implementing as Single Window System, so that all No-Objections/Permits/Sanctions required for setting up an industry are provided to entrepreneurs in one place, promptly and easily and this underlines  the need  to empower Maitri Cell.

GOVERNMENT RESOLUTION:-

            The Government has resolved to implement a Single Window System, so that all No-Objections/Permits/Sanctions required for setting up an industry in the state  can be obtained by entrepreneurs promptly, easily and in one  place and for the  Maitri Cell is being  empowered.

            2. Responsibility and Scope of Maitri Cell:-

            To achieve following goals, the responsibility of facilitating transitional course leading to implementation of the projects is hereby entrusted to Maitri Cell:-

                1] To provide common place of contact to the investors for getting all sanctions.

                2] To provide online sanctions in a time-bound manner. 

                3] To resolve difficulties which arise during the course of setting up of a project and thereafter.

            Presently, “Maitri” Forum has been functioning as an information/Facilitation Centre and Grievance Redressal Machinery for the entrepreneurs and industries in the state. In order to improve ratings of the country in the World Bank’s Ranking on the Ease of Doing Business, to make “Make in Maharashtra” Programme successful and to achieve the aforesaid goals, the scope of “Maitri” Cell is being further expanded.

            3. Services rendered by Maitri Cell and its’ Powers:-

            Instead of confining the scope of Maitri Cell to the limited extent of a stereotype Facilitation/Grievance Redressal Machinery offering help to the State entrepreneurs in establishing their industries, it has been proposed to provide the services of following departments by inducting therein comprehensive services. Hence, the composition and powers of the existing Maitri Cell are made more extensive and powerful.

            Presently, the Nodal Officers of various departments posted in the existing Maitri Cell come together for a meeting presided  over by the Development Commissioner (Industries), every second Friday of the Month and assist industries offering investment in excess of Rs. 10 Crore.  Now in order to facilitate easy and prompt procurement of various Permits/No-Objections, the Maitri Cell is being empowered by creating therein various posts and filling them with the appointment of officers from the concerned department on deputation by making a long standing arrangement.

            The concerned department should notify the following captioned service under the Right to Public Services Act, 2015. Furthermore, the concerned department/Agency should prescribe a definite time limit for providing those services under the State Right to Public Service Act.

            As per expediency and with the permission of the Principal Secretary (Industries), addition shall be made to the list of services provided by Maitri under the Right to Public Services Act.

             4. Duties and Responsibilities of Maitri Cell:-

                1] Department-wise service of the Government provided to industries through Maitri Cell are set out in Column No.3 pertaining to services.

                2] The concerned departments should notify the captioned services under the Right to Public Services Act, 2015 and the concerned Department/Agency should prescribe a definite time limit for providing those services under the State Right to Public Services Act.

                3] Officers from various departments shall work as whole time Nodal Officers.

                4] It is necessary to grant permission/permit to the units within the time limit prescribed under the State Right to Public Services Act and the responsibility thereof shall rest upon the Designated Officer in the concerned department.

                5] Representations and applications received by the Maitri Cell, requiring Permits/No-Objections of the Departments, shall be forwarded by post/online to the concerned departments. If the concerned department does not take  a decision regarding permission within the time limit prescribed under the State Right to Public Services Act, the said services concerning the application shall not vest in the Appellate Officer of the concerned department but shall vest in the concerned Nodal Officer in the Maitri Cell. In other words, the concerned departments should make an amendment to the details of services provided under the Right to Public Services Act, to the effect that in the cases received by the Maitri Cell, the Nodal Officer in Maitri Cell and the President of Maitri Cell shall serve as the First and Second Appellate Authorities under the Sate Right to Public Services Act.

                6] If the concerned department does not  take a decision on the permission/permits/No-Objections in the cases mooted by the Maiti Cell within the time limit prescribed  under the State Right to  Public Services Act, then on the expiration of time limit the applications forwarded by the Maitri Cell shall be transferred to the Maitri Cell and in such applications directions in First Appeal shall be given by the Nodal Officers nominated in the Maitri Cell, requiring the concerned Authorised Officer to complete procedure within the prescribed time. If no action is taken even during this period, the President of Maitri Cell shall take a case-wise decision and grant permission/permit.

                7] The powers concerning permits under Acts/Government Resolutions/Regulations have been decentralised by the Heads of respective departments and accordingly the powers to sanction permits on the basis of project investment/production/site etc., have been conferred upon various officers. The powers of the concerned Heads of Departments shall be conferred upon the Nodal Officers in the Maitri Cell. Accordingly, the concerned department should amend their Rules/Acts, as the case may be.

                8] The State Government, if it finds so expedient, shall transfer powers other than the powers of the concerned bodies to the “Maitri” Cell under an appropriate Notification. The powers delegated to the “Maitri” Cell shall subsist during the period from the stage of production up to tenure of the project.  

            5. Procedure governing Proceedings of Maitri Cell:-

            Due to Revised Model of “Maitri” Cell, economic progress of the state will receive boost, thereby accelerating development and this will realise the goal of “Make in India” through the medium of “Make in Maharashtra”.

                1] The entrepreneurs are required to make an online joint application for No-Objection/Permits/Sanctions required by them for setting up an industry under “Make in Maharashtra” in a single place under “Single Window System”. The entrepreneurs may also apply to the original departments for the services required for setting up an industry.

                2] Forms of various department-wise applications for the services provided by Maitri Cell shall be made available and the applicants would be required to upload their applications on the computer system. Once such application is received by the Maitri Cell, it would be forwarded to the concerned department by computer system, wherever such online services are available. Furthermore, in case of departments where online facilities are not available, such applications shall be despatched by post for prompt action.

                3] An online wallet shall be made available for the payment of prescribed charges by means of MahaOnline, in respect of scrutiny/processing fees charged from industries for obtaining permits and accordingly, the prescribed charges shall be credited to the concerned department.

                4] The concerned departments are required to take a decision within the prescribed time limit under the State Right to Services Act and on the despatch of application to the departments by Maitri Cell, Application Tracking process shall begin.

                5] In case of some departments it is necessary to obtain field inspection reports before sanctioning permits to the industries; in such cases, co-operation of the field office of the concerned department shall be enlisted by the Maitri Cell.

                6] Single Window System shall be implemented at the level of state in proportion to the amount invested in the project and this investment limit shall be fixed as per requirement.

                7] The Development Commissioner (Industries) shall be the President of “Single Window System — Maitri Cell”. Moreover, this Cell shall function under the monitoring and guidance of the Principal Secretary (Industries).

                8] The powers to grant Permits/No-Objections/Sanctions, when the concerned administrative departments do not sanction them within the time limit prescribed under the State Right to Services Act, are hereby delegated under this Government Resolution to the Nodal Officers of the concerned department appointed in “Maitri” Cell.

                9] Upon issue of this Government Resolution, the concerned departments would not be required to issue a separate order for the appointment of officers. Once an order regarding appointment in Maitri Cell is received, the officers from the concerned departments would be required to report for duty within a week.

            6. The Powers and Functions of the President:-

                (i) He shall exercise day-to-day administrative supervision and control over all Nodal Officers and Staff Members in the Maitri Cell.

                (ii) He shall accept, co-ordinate and sanction all investment proposals, including proposals for new investment and modernization, upgradation and expansion of the existing industrial units.

                (iii) He shall offer assistance to giant industrial projects in bringing their investment and shall sanction them collective incentives.

                (iv) He shall encourage industries to bring new investment in various sectors in the state and shall make all necessary endeavors to realise such investment projects in reality.

                (v) He shall make endeavors to procure new investment in the state from private and public sector, shall accept applications for new investment and shall make coordinating efforts to secure all statutory and other sanctions for such units.

                (vi) In collaboration with the Maharashtra Industrial Development Corporation, shall organise campaigns, programmes, missions, symposiums and meeting in the country and abroad, in order to promote Maharashtra as the leading and number one choice by way of an attractive forum for domestic and overseas industrial investment.

               (vii) He shall co-ordinate with the concerned departments and resolve inter-departmental problem and difficulties of all entrepreneurs.

                (viii) He shall offer such assistance that will facilitate actual and early investment in the project by the investors.

                (ix) In the discharge of functions of the Maitri Cell and with the prior approval of the competent officers, shall attest all documents at the behest of the Maitri Cell.    

                (x) shall coordinate with  various department and start implementation for improving Department-wise Index Ratings of the state in the light of progress  made by various states at national level in implementing various returns in furtherance of “Ease of Doing Business” mooted by the Central Ministry of Commerce and Industries.

                (xi) He shall have powers to appoint Nodal Officers in Maitri Cell for the effective implementation of Single Window System. Moreover, with the sanction of the Principal Secretary (Industries) and as per requirement, shall engage the services of consultants and contract staff in Maitri Cell and the expenses incurred on these contractual services shall be borne by the Maharashtra Industrial Development Corporation.

            7. Services provided by “Maitri” Cell and Grievance Redressal:-

            Instead of limiting the object of Single  Window System to the extent of offering assistance to industries in obtaining permits/licences for the advancement of entrepreneurship, it is expected to expand its operational area by taking stock of the difficulties, as well as grievances of industries in obtaining the following  No-Objection  Certificates/Permissions/Field Reports in general, which arise during the course  of setting up an industry and the period preceding thereto, and to resolve them.

            With the permission of the Principal Secretary (Industries) and as per requirement, addition shall be made to the list of subjects, inviting redressal of grievance by Maitri.

            8. Composition and Functions of Maitri Cell:-

                1] The Development Commissioner (Industries) shall serve as the President of the Maitri Cell and co-ordinate its day-to-day affairs.

                2] There shall be 17 Nodal Officers in the Maitri Cell, who shall be regular Government Officers to be appointed on deputation from various departments, with 16 Junior Officers from the concerned departments to assist them in the day-to-day work. Furthermore, 8 Industries Inspectors from the Directorate of Industries shall be provided to assist them in the said cell as inspecting Inspectors.  

                3] Officers and Staff in a specific class from the concerned administrative departments are provided to act as Nodal Officers.

                4] It is necessary to create 17 new posts of Nodal Officers in the Maitri Cell, to be drawn from various classes subordinate to various departments. Moreover, 16 Junior Officers from the concerned departments to assist them in the day-to-day work and 8 Industries Inspectors from the Directorate of Industries to assist them as inspecting Inspectors, thus a total 41 new posts are required to be created. On the proposal for the creation of these new posts, orders shall be issued after approval from the High Level Committee.

                5] Department of Industries shall coordinate with other departments and initiate action for the grant of sanctions by implementing Single Window System though “Maitri” Forum. For this, whole time consultants shall be appointed in the Maitri Cell to look after its day-to-day work and take follow-up action.

                6] The President of the ‘Maitri” Cell shall be empowered to delegate the powers of any officer in the Maitri Cell, concerning a particular department/body to any other officer.

                7] The terms and conditions, as well as functions and duties of the officers and staff appointed in the ‘Maitri” Cell shall be specified by “Maitri”. However, the aforesaid officers who are appointed in “Maitri”, shall continue to be governed by the Rules and Regulations applicable to their parent department/body in the concerned class.

                8] For facilitating day-to-day administrative work of the Maitri Cell and having regard to the ever increasing workload of the cell, various posts shall be filled up by contractual appointment, with the sanction of the President, as per requirement.

            9. Powers to Resolve Difficulties:-

            If any difficulty arises during the course of business of the “Maitri” Cell, the President of the cell with a view to resolving the service, shall make a reference to the Empowered Committee presided over by the Hon’ble Chief Secretary, constituted under Government Resolution in the Department of Industries, dated 08/01/2015, along with his suggestions/proposals in that regard and the decision of the Empowered Committee in that regard shall be binding. Moreover, if during the course of business certain cases call for amendments of statutory nature, such as amendment of any Acts/Rules., omission of some procedures, a proposal shall be forwarded through Empowered Committee for the sanction of Cabinet Sub-Committee.

            10. Power to give directions:-

            The Department of Industries shall have powers to give Policy Directions regarding all matters entrusted to the Maitri Cell, as also in the matter of recommendations to the concerned department for the appointment of Nodal Officers in Maitri Cell, making addition to the list of services provided by Maitri Cell etc; and such directions shall be binding on “Maitri” Cell.                

            11. Financial Provisions:-

            Funds required by “Maitri” Cell shall be provided by the State Government each year, by way of budgetary provision. A separate Account Head shall be opened for this purpose and supplementary demands shall be submitted to the Legislature. However, for early commissioning of this Cell, funds shall be procured from the Maharashtra Industrial Development Corporation, pending availability of funds by budgetary provision. From this fund, the expenditure on the monthly emoluments and allowances payable to the officers/staff appointed in the Maitri Cell, office expenses, vehicle/fuel and other like expenses, are expected to be met. For creating posts in this Cell, an annual non-recurring expenditure of Rs.12.36 Crore and Rs. 1 Crore towards recurring expenditure, thus a total expenditure of Rs.13.36 Crore is expected.

            The aforesaid Government Resolution has been issued pursuant to Informal Reference No:- 73/2015, dt.18.12.2015 in the Department of Finance.
