Preface:-
The Central Government, with a view to regulating the employment and conditions of service of the workers working in the field of building and other construction work, providing for their security and health and in general to undertake welfare measures for them, had enforced the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. In furtherance thereof, and for the implementation of the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, the Maharashtra Building and other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2007 came to be framed. Under Section 18 of the said Act, the Maharashtra Building and other Construction Workers Welfare Board was established in the State.
Under Section 3(1) of the Building and other Construction Workers Welfare Cess Act, 1996, the Central Government, vide its Notification Dated 26.06.1996 has fixed a cess to the extent of 1% of the total Project Cost (excluding the land value). Accordingly, the workers working in the building and other construction work sector in the State are registered and their Registration is renewed by the Board and various Welfare Schemes are implemented by the Board from the cess fund credited with the Board for the construction workers whose Registration is active (alive).
The Central Government has repealed 29 Labour Laws and enforced four new Labour Codes throughout the country with effect from 21st November, 2025. Under these Codes, the Acts at Reference Nos. 1 and 2 have been repealed and now the matters pertaining to the welfare of Building and other Construction Workers have been incorporated in the “Code on Social Security-2020”.
Section (7)(6) of the said Code set out the matters which require implementation of various Welfare Schemes for the construction workers. Accordingly, Section (7)(6)(a) contains a provision to the following effect – “provide death and disability benefits to a beneficiary or his dependents”.
Pursuant to the said provision, the Board in its Meeting, Dated 12.05.2026 passed a Resolution and submitted to the Government a Proposal for starting afresh a Death Assistance and Disability Assistance Scheme for the construction workers whose registration with the Board is alive (active), vide Reference No. 9 above. The construction workers are working at the sites involving risk. They suffer death or disability in the accidents caused at the construction sites. Hence, in order to provide them and their dependents assistance in such event, the Government contemplated the matter of revoking the existing scheme started by the Board for the registered construction workers and to start a Revised “Death Assistance and Disability Assistance Scheme” as per the provisions of the Code on Social Security.
Government Resolution:-
Sanction is hereby accorded under this Government Resolution to discontinue the existing schemes of the Maharashtra Building and other Construction Workers Welfare Board, viz. Death Assistance Scheme (Funeral Assistance – Amount Rs. 10,000/- One Time (F-06), Heir Assistance – Rs. 24,000/- per year for five years (F-07), Actual Expenditure incurred on hearse van (F-08), existing Scheme for the transplant of artificial limbs for the disabled persons – Actual Expenditure incurred (H-07) and to start a Revised “Death Assistance and Disability Assistance Scheme” for the construction workers whose Registration is alive (active).
Accordingly, this Scheme comprises three items viz. Natural Death Assistance Scheme, Accidental Death Assistance Scheme and Disability Assistance Scheme and the summary of the name of the Scheme, Eligibility Criteria, Financial Assistance and the necessary documents required therefor, are set out in “Proforma-A”.
(2) The expenditure incurred on this Scheme should be met from the cess credited to the Maharashtra Building and other Construction Workers Welfare Board, Mumbai.
(3) If an Applicant furnishes false information, the benefits disbursed to him shall be recovered and the Registration of the worker shall be revoked. Moreover, such worker shall be liable for criminal prosecution.
(4) Pursuant to the Code on Social Security, 2020 and in light of the provisions of this Government Resolution, necessary modifications should be made to the Computer Portal of the Board in respect of the Revised Death and Disability Assistance Scheme for the Registered Construction Workers of the Board.
(5) The said Scheme shall be implemented by the Maharashtra Building and other Construction Workers Welfare Board, Mumbai. The Secretary-cum-Chief Executive Officer should take necessary steps for the implementation of this Scheme.
