Preface:-
The Central Government, with a view to regulating the employment and conditions of service of the workers working in the field of building and other construction work, providing for their security and health and in general to undertake welfare measures for them, had enforced the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996. In furtherance thereof, and for the implementation of the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, the Maharashtra Building and other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2007 came to be framed. Under Section 18 of the said Act, the Maharashtra Building and other Construction Workers Welfare Board was established in the State.
Under Section 3(1) of the Building and other Construction Workers Welfare Cess Act, 1996, the Central Government, vide its Notification Dated 26.06.1996 has fixed a cess to the extent of 1% of the total Project Cost (excluding the land value). Accordingly, the workers working in the building and other construction work sector in the State are registered and their Registration is renewed by the Board and various Welfare Schemes are implemented by the Board from the cess fund credited with the Board for the construction workers whose Registration is active (alive).
The Central Government has repealed 29 Labour Laws and enforced four new Labour Codes throughout the country with effect from 21.11.2025. Under these Codes, the Acts at Reference Nos. 1 and 2 have been repealed and now the matters pertaining to the welfare of Building and other Construction Workers have been incorporated in the “Code on Social Security-2020”.
Section (7)(6) of the said Code set out the matters which require implementation of various Welfare Schemes for the construction workers. Accordingly, Section (7)(6)(d) contains a provision to the following effect – “frame educational schemes for the benefit of children of the beneficiaries as may be prescribed by the appropriate Government”.
Pursuant to the said provision, the Board in its Meeting, Dated 12.05.2026 passed a Resolution at Reference No. 9 and had submitted to the Government a Proposal for extending various Educational Assistance Schemes to the first two wards of the construction workers whose registration with the Board is alive (active).
Under the Right to Education Act, 2009, free education is imparted to all children in the Age Group of six to fourteen (First Class to Eighth Class). Hence, Assistance in the form of direct grant is not required; yet, they require Basic Items. Nevertheless, the financial burden of the education of the wards after the Eight Class falls on such construction workers. Class Ten and Class Twelve are two are crucial stages in the education of these wards and as such it becomes imperative to take special care to ensure that their education is not interrupted. In view of all these factors and having regard to the future of wards in various Age Groups, the Government contemplated the matter of revoking the ongoing schemes started by the Board for the first two wards of the Registered construction workers and extending a Revised “Educational Assistance Scheme” to the first two wards of the construction workers whose Registration with the Maharashtra Building and other Construction Workers Welfare Board, Mumbai is alive (active), pursuant to the aforementioned provisions of the Code on Social Security, 2020.
Government Resolution:-
Sanction is hereby accorded under this Government Resolution to discontinue all ongoing Educational Assistance Schemes started by the Maharashtra Building and other Construction Workers Welfare Board, Mumbai for the first two wards of the construction workers whose Registration with the Board is alive (active) and to start a Revised “Educational Assistance Scheme”, pursuant to the aforesaid provisions of the Code on Social Security, 2020.
Accordingly, this Scheme comprises seven educational items and the summary pertaining to the name of the Scheme, Eligibility Criteria, Financial Assistance and necessary documents etc., is set out in “Proforma-A” enclosed herewith.
(2) The Maharashtra Building and other Construction Workers Welfare Board, Mumbai shall finalise the selection of essential items forming part of the Basic Items Kit, with the sanction of the Government.
(3) The expenditure incurred on this Scheme should be met from the cess credited to the Maharashtra Building and other Construction Workers Welfare Board, Mumbai.
(4) Pursuant to the Code on Social Security, 2020 and in light of the provisions of this Government Resolution, necessary modifications should be made to the Computer Portal of the Board in respect of the Revised Educational Assistance Scheme for the wards of the Registered Construction Workers of the Board.
(5) If an Applicant furnishes false information, the benefits disbursed to him shall be recovered and such worker shall be liable for criminal prosecution.
(6) The said Scheme shall be implemented by the Maharashtra Building and other Construction Workers Welfare Board, Mumbai. The Secretary-cum-Chief Executive Officer should take necessary steps for the implementation of this Scheme.
This Government Resolution has been made available on the website of the Government of Maharashtra viz. www.maharashtra.gov.in and its Code Number is 202607131302408010. This Resolution is attested and issued under Digital Signature.
