Preface:-
Under Government Resolution Dt.16th May, 2018, the Government has adopted the policy of carrying out paid Rehabilitation of the hut holders actually occupying the huts which were in existence from 01.01.2000 to 01.01.2011 under the Slum Rehabilitation Scheme. Furthermore, under Government Resolution Dt. 25.05.2023, the cost of paid Rehabilitation Flat under the Slum Rehabilitation Scheme has been fixed. Against this backdrop, the Government contemplated the matter of issuing Guidelines for revising some of the provisions and adding some new provisions to the Government Resolution Dt.16.05.2018.
Government Resolution:-
1] All Terms/Conditions regarding eligibility/non-eligibility of the hut/hut holder for paid rehabilitation contained in the Government Resolution in the Department of Housing Dt. 16.05.2018, as well as Appendices thereto, shall continue.
2] Since the cost of paid rehabilitation flat has been fixed straightaway at Rs.2.50 Lakh, the provision contained in Point No. 7 of the Government Resolution Dt. 26.05.2018 hereby stands omitted. Moreover, the Government shall have the powers to revise the cost of paid rehabilitation flats, commensurate with changing times.
3] Since paid rehabilitation under Government Resolution Dt. 16/05/2018 is in consonance with the Mission “Housing for All” and having regard to the objects of this Government Resolution paid rehabilitation shall be available only for the residential user. The hut holders cannot be extended the benefits of paid rehabilitation for commercial/industrial user.
4] Since Rs. 2.50 Lakh – the cost of paid rehabilitation flat fixed under Government Resolution Dt. 25.05.2023 is very reasonable, the provision of Section 3E of the Maharashtra Slum Areas (I, C & R) Act, 1971 shall apply to the transfer of such flats by purchase/sale.
5] Point No.12 of the Government Resolution Dt. 16/05/2018 stipulates that a hut holder who is eligible for free of cost rehabilitation flat under Slum Rehabilitation Scheme can relinquish his entitlement to such flat and participate in the paid rehabilitation scheme. This provision is hereby stands omitted and henceforth a hut holder who is eligible for free of cost rehabilitation flat can not participate in the paid rehabilitation scheme.
6] The area of paid rehabilitation flat under Slum Rehabilitation Scheme shall be governed by the provisions of the prevailing Acts/Rules.
