Preface:-
Pursuant to Government Resolutions in the Department of Urban Development bearing No:-TPV.4397/1899/Pra.Kra.201/97/UD-11, Dt. 10.11.1997 and No:-TPS-1919/173/Pra.Kra.38/19/UD-13, Dt.27.05.2019, action is initiated under the provisions of Section 143 of the Maharashtra Regional and Town Planning Act, 1966 for the amicable settlement of the offences committed by the developers by levying compounding charges in respect of unauthorised constructions. While initiating such action compounding charges are levied by taking into account the rates of construction/rates of lands set out in the Annual Statement of Market Rates sanctioned by the Inspector General of Registration and Controller of Stamps, Maharashtra State, Pune. However, a sense of apathy is noticed amongst the citizens and the entrepreneurs about paying such compounding charges. Hence, the Government contemplated the matter of extending a Promotional Amnesty Scheme to encourage citizens and entrepreneurs to pay such compounding charges for the Regularisation of unauthorised structures within the operational areas of Nashik and Chhatrapati Sambhaji Nagar Metropolitan Region Development Authority which would achieve Regularisation of unauthorised construction and thereby derive some revenue.
Government Resolution:-
The Government has resolved to extend “Amnesty Scheme” in the matter of compounding/condonation charges presently charged by Nashik and Chhatrapati Sambhaji Nagar Metropolitan Region Development Authorities within their operational areas as one time special matter.
1. “Instead of the compounding/condonation charges presently levied by the Nashik and Chhatrapati Sambhaji Nagar Metropolitan Authorities, the concerned structures holders are hereby permitted to pay 50% amount during the initial 6 Months and 75% amount during the subsequent 6 Months by way of compounding/condonation charges”.
2. This Amnesty Scheme is hereby made applicable from the date of this Government Resolution.
3. After the lapse of 12 Months period specified above, compounding charges should be levied as per the prevailing procedure.
4. Prior to establishment of the aforesaid Authorities, some constructions in the areas of Village Panchayats were carried out with the permission of Village Panchayats. In view thereof, the constructions carried out with the permission of Village Panchayats should be considered. However, the remaining excess constructions should be regularised by levying compounding charges.
