Preface:-
The Welcome Trust and others have filed Public Interest Petition No. 116/2009 before the Hon’ble High Court, Mumbai. In this Petition, the Government of Maharashtra and the Municipal Corporation for Greater Mumbai too have been impleaded as the Respondents. In this Petition, the Petitioners have raised certain issues viz. whether Shivaji Park Ground is a Reserved Ground and/or Playground, declaration of Shivaji Park as silence zone and highlighting the fact that the Ground is being used for the objects other than the declared objects. On 4th January, 2013, the Hon’ble High Court, Mumbai passed orders in the instant case.
As per the provisions of Section 37A of the Maharashtra Regional and Town Planning Act, 1966, Shivaji Park Ground at Dadar, Mumbai can be used for non-sports activities such as, National Functions of Independence Day, Republic Day, Maharashtra Day, birth and death anniversaries of national leaders, as well as public meetings and religious reasons/festivals for 45 days in a year. As per the provisions and pursuant to the orders dated 4th January, 2013 passed by the Hon’ble High Court, Mumbai in the instant case, the Government had earmarked its permission for the use of Shivaji Park Ground at Dadar for non-sports activities, such as Children’s Day Programme, Republic Day, Maharashtra Day, Independence Day, Ganesh Immersion, Dasara Gathering and Dr. Babasaheb Ambedkar Mahaparinirvan Din, for a total 34 days in a year and placed an Advertisement in the newspapers Dt. 21.11.2015, inviting Representations from the parties who were interested in organizing their programmes at Shivaji Park Ground for the remaining 11 Days, by submitting their applications within 20 days of the date of advertisement to the Department of Urban Development, 4th Floor, Mantralaya, Mumbai or at E-Mail address – udd.ud21@gmail.com. After considering the representations received in response to the said Advertisement, the Government contemplated the proposal of permitting use of Shivaji Park Ground at Dadar, Mumbai for Non-Sports Activities, each year. In furtherance thereof, the Government has resolved as hereunder:-

Accordingly, the Government hereby proceeds to permit the use of Shivaji Park Ground at Dadar, Mumbai for the following Non-Sports Activities, each year:-

02. The Commissioner of the Municipal Corporation for Greater Mumbai should permit the concerned parties to use Shivaji Park Ground at Dadar, Mumbai for the aforesaid activities, subject to following conditions:-
[A] On the condition that the provisions of the Nosie Pollution (Regulation and Control) Rules, 2000 shall be complied with;
[B] On the condition that the stipulations in the order dated 4th January, 2013 passed by the Hon’ble Court shall be obeyed;
[C] That wherever necessary, permission of police officers shall be obtained.
[D] Such other Terms and Conditions as the Municipal Corporation may deem fit while reserving the Ground.
