Implementation of Slum Rehabilitation Schemes in Mumbai Metropolitan Region through other Corporations/Authorities/Local Self-Government Bodies on Joint Venture Basis

Preface:-

            The Government was contemplating the matter of permitting development of Slum Rehabilitation Scheme Projects in Mumbai Metropolitan Region through other Corporations/Authorities/Local Self-Government Bodies such as Mumbai Municipal Corporation, Thane Municipal Corporation, Mumbai Metropolitan Region Development Authority, CIDCO, MHADA etc. on Joint Venture basis, instead of through the Slum Rehabilitation Authorities.

GOVERNMENT RESOLUTION:-

            Sanction is hereby granted for implementing some Slum Rehabilitation Schemes in the Mumbai Metropolitan Region through other Corporations/Authorities/Local Self-Government Bodies, such as the Municipal Corporation for Greater Mumbai, Thane Municipal Corporation, Mumbai Metropolitan Region Development Authority, CIDCO, MHADA etc., on Joint Venture (JV) basis.

            The terms and conditions governing Slum Rehabilitation Schemes to be implemented on Joint Venture basis, shall be as hereunder:-

            1] Slum Rehabilitation Schemes in Mumbai Metropolitan Region shall be implemented in Joint Venture between the Slum Rehabilitation Authority and the Municipal Corporation for Greater Mumbai/Thane Municipal Corporation/Mumbai Metropolitan Region Development Authority/CIDCO/MHADA. Furthermore, other willing Authorities/Bodies too can participate in this Scheme.

            2] If Developers are not able to implement stalled Slum Rehabilitation Schemes, such stalled schemes, too, shall be implemented on Joint Venture basis.

            3] In case of such stalled schemes, steps for replacing the Developer under Section 13(2) of the Maharashtra Slum Areas (IC&R) Act, 1971, shall be taken by the concerned Slum Rehabilitation Authority.

            4] Before effecting transfer of Slum Rehabilitation Schemes on the plots of Authorities/Local Self-Government Bodies to the concerned Authorities/Local Self-Government Bodies, it would be necessary to examine the scheme-wise financial and technical feasibility.

            5] For such Rehabilitation Projects, Bi-Partite Agreements will have to be executed between the concerned Corporations/Authorities/Local Self-Government Bodies and the concerned Slum Rehabilitation Authority.

            6] For such Slum Rehabilitation Schemes on Joint Venture basis, the Slum Rehabilitation Authority, itself shall act as the Planning Authority.

            7] Construction of the Rehabilitation Component and Saleable Component under such Schemes shall be carried out by the concerned Authority/Local Self-Government Body and the Saleable Component accruing therefrom, shall be sold in open market by the concerned Authority/Local Self-Government Body under “Affordable Housing for All” and the cost of construction and other expenditure incurred on the same, shall be defrayed.

            8] While implementing Slum Rehabilitation Schemes in Mumbai Metropolitan Region on Joint Venture basis, initially construction of Rehabilitation Component should be completed. The concerned Authorities/Local Self-Government Bodies shall be permitted to plan its Saleable Component, sale price etc. and thereby derive its financial earnings. Hence, the concerned Authorities/Local Self-Government shall not be paid any subsidy by the Slum Rehabilitation Authority or Government towards the cost of the Project.

            9] Since the concerned Authorities/Local Self-Government Bodies stand to earn income from the Saleable Component, such concerned Authorities/Local Self-Government Bodies shall make arrangement vis-à-vis the rent payable to hut holders/flats in the temporary Transit Camps.

            10] In case of stalled Slum Rehabilitation Schemes, the Authorities/Local Self-Government Bodies implementing Joint Venture Schemes, shall be obliged to carry out evaluation of the construction carried out by the outgoing Developers and pay such worked out amount to the concerned Developers.

            The proposals received under the said Schemes shall be duly inspected/scrutinised by the Slum Rehabilitation Authority and such proposals shall be forwarded for sanction to the Government. The following Committee presided over by the Secretary/Principal Secretary/Additional Chief Secretary (Housing) is hereby constituted to take decision on the proposals received by the Government.
