Clarification regarding the Mithi River Development and Protection Authority

Preface:-
Under the aforestated Government Resolution, the Mithi River Development and Protection Authority was established to undertake development of the Mithi River and the Operational Scope of the Authority and the Members of the said Authority were fixed. Moreover, an Empowered Committee was also constituted for the implementation of the Plan sanctioned by the said Authority. In the Meeting of the said Empowered Committee held on 22nd February, 2014 it was decided to issue a clarification regarding the Coordinating and Implementing Agency pertaining to acquisition of land abutting the Mithi River and such other works. Accordingly, the Government contemplated the matter of issuing a clarification regarding co-ordination of works pertaining to acquisition of land abutting the Mithi River and other works, as well as the work to be undertaken by the Mithi River Implementing Agency. Accordingly, the Government has resolved as hereunder:-
Government Resolution:-
The Mithi River Development and Protection Authority has been coordinating the works undertaken by various Agencies vis-à-vis development of Mithi River and Wakola Nullah; but, the Authority does not have the statutory status. As such, the Mithi River Development and Protection Authority does not have the powers to undertake acquisition of land and rehabilitation of the project affected persons and such types of works. Hence, clarification vis-à-vis the works to be undertaken by the concerned “Planning Authority”, through whose area the Mithi river and Wakola Nullah traverse, insofar as they pertain to the development of Mithi river and Wakola Nullah viz. Implementation of project, acquisition of land, rehabilitation of the project affected persons and such other project works, is introduced as hereunder:-
[A] Regarding Mithi River:-
(1) For an estimated length of 11.84 KM of the Mithi River from Vihar lake up to CST Bridge on Santacruz- Chembur Link Road, the Municipal Corporation for Greater Mumbai shall act as the Planning Authority and Competent Authority for the implementation of all works pertaining to the Mithi River, as well as rehabilitation of project affected persons, acquisition of land etc.
(2) For an estimated length of 6 KM of the Mithi river from CST Bridge on Santacruz- Chembur Link Road up to Mahim Creek, the Mumbai Metropolitan Region Development Authority shall act as the Planning Authority and Competent Authority for the implementation of all works pertaining to the Mithi river, as well as implementation of the project, rehabilitation of the project affected persons, acquisition of land etc.
[B] Regarding Wakola Nullah:-
(1) For an estimated length of 2 Km of Wakola Nullah which eventually joins Mithi river, from the Airport up to Wakola Bridge on Santacruz- Chembur Link Road, the Municipal Corporation for Greater Mumbai shall act as the Planning Authority and Competent Authority for all such works including the works pertaining to Wakola Bridge, implementation of the project, rehabilitation of the project affected persons, acquisition of lands etc.
(2) For an estimated length of 1.8 Km of Wakola Nulla, which eventually joins Mithi river, from the Wakola Bridge on Santacruz- Chembur Link Road up to the confluence of the Mithi River and Wakola Nullah in Bandra- Kurla Complex, the Mumbai Metropolitan Region Development Authority shall act as the Planning Authority and Competent Authority for all such works, including the works pertaining to the Wakola Nullah, implementation of the project, rehabilitation of the project affected persons, acquisition of lands etc.
If no special funds are received for the aforestated works from the Mithi River Development and Protection Authority, then the Mumbai Municipal Corporation for Greater Mumbai and Mumbai Metropolitan Region Development Authority should bear all types of expenses on the woks undertaken within their respective limits delineated above.
The Mithi River Development and Protection Authority shall mainly secure co-ordination between the aforesaid Agencies and implement the orders issued by the Empowered Committee.
