Implementing Dharavi Development Action Plan for the Comprehensive Development of Dharavi- the largest slum in the continent of Asia

Preface:-

            Dharavi is a centrally located largest slum site in the continent of Asia and it is spread over an area of 174 hectares, linking Mumbai with Mumbai suburbs, along its east and west phalanges and it stands in close proximity to the National Highways which start in Mumbai and is affiliated to all three Railway Routes  of Central Railway, Western Railway and the Harbour Railway and is also famed for being an industrial centre comprising small scale industry and manufacturing components complimenting their needs, besides housing middle-class settlements. If this slum is developed with means of transportation, we will have a well developed centralised place, linking Mumbai in all four directions and we can carry out rehabilitation of its slum dwellers. Because of its dense population and large small scale industry, it is not feasible and financially viable to implement Rehabilitation Schemes on a number of small plots under the existing Slum Rehabilitation Scheme. Hence, the Government contemplated the matter of framing a comprehensive scheme for the development of entire Dharavi area by dividing the entire Dharavi area into several sectors and achieving its appropriate and planned development on optimum commercial basis.

Government Resolution:-

            Following decisions have been taken vis-à-vis the Dharavi Redevelopment Scheme:-  

            (1) For achieving comprehensive, financially viable and self-sufficient Redevelopment of Dharavi under the Dharavi Redevelopment Scheme, the proposal envisaging division of area into 9 Sectors and the anticipated expenditure of Rs. 5,600 Crore by means of privatization is hereby sanctioned.

            (2) Sanction is hereby accorded for the zoning and Sectors proposed under the Dharavi Redevelopment Scheme and the powers to modify the size/number of Sectors as per requirement are hereby delegated to the Secretarial Committee presided  over by the Hon’ble Chief Secretary.

            (3) This Development shall be implemented in conformity with the existing criteria of the Slum Rehabilitation Scheme. The Developer, in each Sector, shall make a presentation of the planning for each Sector and shall implement the same on piecemeal basis. For this purpose, a Global Advertisement for the entire Plan shall be placed inviting proposals from the Developers. The Slum Rehabilitation Authority shall scrutinize the proposals, so received and place them for the final  decision before the Secretarial Committee constituted as hereunder:-

            (4) Once the aforesaid Secretarial Committee sanctions proposal of the Developer, the Slum Rehabilitation Authority shall proceed to take further action.

            (5) Steps shall be taken by the Department of Urban Development to declare the Slum Rehabilitation Authority as the Special Planning Authority.

            (6) For speedy completion of Dharavi Redevelopment Work the condition requiring he Developer to obtain consent of 70% slum dwellers is relaxed up to 60%.

            (7) Sanction is hereby accorded for the use of in-situ Floor Space Index within limit of 4.00, confined to Dharavi area only.

            (8) In the event of total Project Floor Space Index exceeding 4.00, sanction is hereby accorded for the consumption of surplus Floor Space Index as Slum TDR, in conformity with the prevailing Rules.

            (9) When such proposal is to be commissioned, action will have to be taken in conformity with the provisions of the Maharashtra Regional and Town Planning Act, 1966.

            (10) The Municipal Corporation for Greater Mumbai shall undertake an elaborate planning of the schemes required for creating infrastructural facilities. The Department of Urban Development shall take a follow-up action for procuring funds from the Central Government.

            (11) The implementation of this Redevelopment Scheme will start with the lands belonging to the State Government and Municipal Corporation. A request shall be conveyed to the Central Government to issue No-Objection Certificate for the lands owned by it.

            (12) Steps shall be taken to acquire private lands under the Maharashtra Housing and Area Development Act, 1971.

            (13) The concerned Department shall take steps to set up a Special Cell for Dharavi by enlisting its present staff for such works as preparation of list of the eligible hut holders, maintaining extracts of Property Record, drawing Land Maps etc.

            (14) For this work a Senior Indian Administrative Service (I.A.S) Officer shall be separately appointed by the Slum Rehabilitation Authority and his expenditure shall be defrayed from the funds of Slum Rehabilitation Authority.

            (15) If an eligible hut holder from Dharavi has a large number of members in his family and as such desires to acquire a flat of larger area, he shall be allotted a flat admeasuring 300 Sq. Feet, if he is ready to migrate to the salt pan lands on which Slum Rehabilitation Schemes are to be implemented. Whether or not to avail of the Scheme of larger area on salt pan lands shall be left to the discretion of the eligible hut holders from Dharavi and shall also depend upon the availability of flats accruing from the saltpan lands.

            (16) The theme of Dharavi Redevelopment Scheme was conceived by Shri. Mukesh Mehta; Moreover, he prepared the Report and attended various Meetings held in Mumbai or Delhi, from time to time, and as such recognizing his significant contribution to the Scheme he is hereby appointed as the Project Consultant. The Secretarial Committee presided over by the Hon’ble Chief Secretary shall fix the Terms and Conditions and emoluments governing this appointment and the expenditure thereof shall be defrayed by the Slum Rehabilitation Authority.   

            (17) Any modifications to the Development Plan for Greater Mumbai as may be warranted by this Scheme, shall be made by the Department of Urban Development in conformity with the provisions of the Maharashtra Regional and Town Planning Act, 1966.
