Preface:-
Ease of Doing Business (EoDB) is one of the ambitious Programmes launched by the Department for Promotion of Industry and Internal Trade (DPIIT) affiliated to the Government of India. The purpose of Ease of Doing Business (EoDB) is to create a favourable Business Ecology in the States and Union Territories of India and it calls for the implementation of various Reformative Measures. Such Reforms are implemented as part of Business Reforms Action Plan (BRAP). In furtherance of the Business Reforms Action Plan -2024, the following three subjects concerning the Revenue Department were discussed:-
1. Integration of Change in Land Use with MAITRI –SWS.
2. Procedure document for change in land use.
3. Dashboard for change in land use.
A provision has been incorporated in Sections 42(a), (b), (c) and (d) and Section 44-A of the Maharashtra Land Revenue Code, 1966 to the effect that permission would not be required for the use of land for a Non-Agricultural purpose. However, under this provision the land holders would be required to obtain a Sanad for the Deemed Non-Agricultural Use and the Government has noticed the fact that it entails the same procedure and time as required for obtaining permission for use of land for Non-Agricultural Purpose. Hence, it has been proposed at the Government level to amend the Maharashtra Land Revenue Code, 1966 and to repeal the provisions vis-à-vis Sanad for Non-Agricultural Use.
Hence, pending Amendment of the Maharashtra Land Revenue Code, 1966 and the completion of procedure for the repeal of provisions vis-à-vis Sanad for Non-Agricultural Use at the Government level and in furtherance of the Business Reforms Action Plan -2024, the Government contemplated the matter of issuing directions in the nature of Guidelines to the effect that if an Industrial Unit wants to start Non-Agricultural Use for an industrial purpose, then such Sanad would not be required.
Government Circular:-
The procedure for carrying out Amendment of Sections 42(a), (b), (c) and (d) and Section 44-A of the Maharashtra Land Revenue Code, 1966 and repealing the provisions requiring a Sanad for Non-Agricultural Permission is in progress. It would require some time. Hence, if an Industrial Unit, during the intervening period pending completion of such Procedure, wants to start Non-Agricultural Use for an industrial purpose, it would not be required to obtain a Sanad for such Non-Agricultural Use. Once an Industrial Unit, which wants to start a Non-Agricultural Use for an industrial purpose, obtains a Development Permission from the Competent Planning Authority or gets the Building Plan approved by the Planning Authority, it should submit a copy, thereof, to the concerned Village Revenue Officer for recording appropriate entries in the Record of Rights. Once the Village Revenue Officer receives such information he should proceed to record the entry in the Record of Rights and complete the procedure for updating the Record of Rights, as soon, as possible.
