Preface:-
Section 38 of the Maharashtra Land Revenue Code, 1966 contains a provision for letting out Government lands on leasehold basis. Moreover, Rule 35 of the Maharashtra Land Revenue (Disposal of Government Lands) Rules, 1971 contains a provision for the renewal of Lease Agreements in case of Government lands granted on Leasehold basis.
02. Government Resolution Dt. 01.08.2019 prescribes a Policy for the renewal of Lease on Government lands which have already expired and which may expire in future, situated in the rest of Maharashtra (excluding Greater Mumbai, Matheran, Mahabaleshwar, “D” Tenure Type Leases in Raigad District, agricultural lands let out on lease, Lease granted for Industrial Estates and Nazul lands in Vidarbha). Moreover, the Revised Policy for the renewal of leases on Government lands situated in Greater Mumbai (Mumbai City and Suburban District) which have already expired came to be fixed under Government Resolution Dt. 12.12.2012 and Government Corrigendum Dt. 17.01.2013.
03. Pursuant to the decision taken by the Hon’ble Cabinet in its Meeting held on 27.01.2026 vis-à-vis the extension of lease tenure of Government lands granted on lease for various purposes for 30 years under the provisions of the Maharashtra Land Revenue Code, 1966 and the Maharashtra Land Revenue (Disposal of Government Lands) Rules, 1971, the Government contemplated the matter of issuing comprehensive Guidelines to all concerned Administrative Departments, Corporations, Boards and Authorities in respect of Government lands owned by various Administrative Departments of the Government or the lands transferred by the Revenue Department for a specific purpose to such Departments, as well the lands owned by the Corporations, Boards and Authorities subordinate to them or the Government lands transferred to the former.
Government Circular:-
The Hon’ble Cabinet in its Meeting held on Tuesday, Dt. 27.01.2026, has issued the following Directions in respect of lands owned by various Administrative Departments of the Government, as well as Corporations, Boards and Administrative Departments subordinate to the former, as set out hereunder:-
“The Government lands owned by various Administrative Departments of the Government or the lands transferred by the Revenue Department for a specific purpose to such Departments, as well as the lands owned by or transferred to the Corporations, Boards and Authorities subordinate to the former, may be let out on lease to various Bodies for various commercial purposes for the augmentation of income of such Corporations, Boards and Authorities, as per requirement, in the first instance, for a maximum of 49 years and subsequently, if no terms and conditions are contravened, the concerned Department may once again renew such lease, subject to the maximum limit of 49 years, by charging appropriate Lease Amount, therefor.”
“Moreover, while letting out Government lands on lease for 49 years, appropriate monitoring should be exercised by the office of the concerned District Collector in respect of such matters as the prospective renewal of the lands let out on lease, periodic enhancement of Ground Rent of the lands let out on lease at certain interval, as well as punctual payment to the Government of the Amount of Ground Rent by the Lease Holders.”
02. All concerned Administrative Departments should bring the aforementioned directions issued by the Hon’ble Cabinet in its Meeting held on 27.01.2026, to the attention of the concerned Boards and Authorities subordinate to them and ensure the scrupulous implementation, thereof.
03. All concerned Administrative Departments should conduct a local enquire through their Agencies as to whether any Terms and Conditions of the Lease Agreements in respect of the lands let out on lease by the Corporations, Boards and Authorities subordinate to them have been violated and in case of breach of conditions, further steps for letting out lands on lease should be taken in conformity with the provisions of this Policy, only upon regularisation of such breach of conditions.
04. This Policy shall not be applicable to the lands let out on lease by the Department of Revenue for residential, commercial or other purposes. The Department of Revenue shall be governed by the Lease Policy already framed under Government Resolution Dt. 12.12.2012 and Dt. 01.08.2019.
05. This Government Circular has been issued with the concurrence of the Department of Finance, vide its Letter bearing No. AaNauSan.Kra.526//2025/Vyay- 9, Dt. 24.09.2025 and pursuant to the decision taken by the Hon’ble Cabinet in its Meeting held on 27.01.2026.
06. This Government Circular has been made available on the website of the Government of Maharashtra viz. www.maharashtra.gov.in and its Code Number is 202604081446062919. This Resolution is attested and issued under Digital Signature.
